These terms cover your Eureka Dairy account, deliveries, and the card you keep on file. By creating an order or subscription you agree to them. Please read them — and keep a copy. Questions? Email eurekadairy@protonmail.com.
1. Who we are
Eureka Dairy is a small family farm in Eureka, in the Northern Rivers of New South Wales, run by Shannen and Elliot. We supply fresh farm products and run a local delivery service across the Gold Coast and Northern Rivers region.
2. Your account
- You must give accurate details (name, contact, delivery address) and keep them up to date in your account.
- You are responsible for keeping your login secure. You must be 18 or over to hold an account and keep a card on file.
- You can update or close your account at any time from your account page, or by contacting us.
3. Our products & raw dairy
- Our milk is raw (unpasteurised) and unhomogenised, from our own small Jersey herd, and is supplied as bath milk. It is labelled accordingly. Please read the label on every product.
- Other products (yoghurt, cheese, chocolate milk and the like) are made in small batches and may vary slightly between runs.
- Our products are farm foods with a short shelf life. Keep them refrigerated and use them by the date and in the way shown on the label.
4. Orders, subscriptions & cut-offs
- You can place a one-off order or set up a recurring delivery (weekly or fortnightly). You choose what's in your crate.
- Orders must be placed before the cut-off time shown at checkout and in your account. Orders after the cut-off go onto the next run.
- You can skip, pause, swap items or cancel a subscription yourself from your account, up to the cut-off for the affected delivery. Changes after the cut-off apply to the following delivery.
- We may occasionally be unable to supply an item (seasonality, a small herd, weather). If so we'll substitute, credit or adjust, and only charge for what we actually supply.
5. Card on file & billing (important)
- To take deliveries you keep a payment card on file. Your card details are captured and stored securely by our payment provider (Stripe) — we never see or store your full card number.
- By keeping a card on file you authorise us to charge it for: the products in each delivery, the delivery fee, and any extras you've agreed to or that are part of your run — for example an ice pack, an additional item, or a re-delivery.
- We charge around the time of each delivery. We'll always be able to show you what each charge was for in your order history.
- If a charge fails, we may pause deliveries until the card on file is updated. You can update or replace your card anytime in your account.
- Prices are shown in Australian dollars and are indicative while we finalise our range. We may change prices with reasonable notice; the price that applies is the one shown when your delivery is confirmed.
6. Delivery
- We deliver along our regular Gold Coast → Ballina run. Enter your postcode or share your location to check your area; if you're outside the run you can choose farm pickup.
- Delivery orders have a $50 minimum. Farm pickup has no minimum.
- We pack cold and deliver to the address or instructions you give us. Please make sure we can safely leave your order, and refrigerate it promptly — once it's delivered as instructed, keeping it cold is up to you.
- Insulated boxes and ice packs stay our property. Please leave them out for collection on your next run so we can keep the service cold and low-waste. Lost or unreturned equipment may be charged to your card on file.
7. Club Cash
Recurring deliveries may earn Club Cash, which you can put toward future orders. Club Cash has no cash value, can't be transferred or withdrawn, and may expire or change — we'll tell you if it does.
8. Refunds & problems
If something arrives not as it should — damaged, missing or not right — tell us within 24 hours of delivery and we'll make it right with a replacement, credit or refund. Nothing in these terms limits rights you have under the Australian Consumer Law.
9. Your information
We use your details only to run your deliveries and keep in touch about your orders. We don't sell your information. Payment details are handled by our payment provider. You can ask us what we hold and ask us to correct or delete it.
10. Liability
We take real care with everything we make and deliver. To the extent the law allows, we aren't liable for loss outside our reasonable control, and our liability for any order is limited to re-supplying it or refunding what you paid for it. This doesn't exclude any rights you can't waive under law.
11. Changes to these terms
We may update these terms from time to time. The current version and its date are shown at the top of this page, and we'll ask you to agree again if we make a material change.
12. Contact & governing law
These terms are governed by the laws of New South Wales, Australia. Questions, changes or anything else: eurekadairy@protonmail.com.
